These Terms of Service apply to your use of the Studio E Gallery website and purchases from SEG Contemporary LLC, doing business as Studio E Gallery (“Studio E Gallery,” “we,” “us,” or “our”), located in Palm Beach Gardens, Florida.

Please review these terms before purchasing. Any written agreement specific to your purchase, including an accepted commission agreement, will control if it conflicts with these general terms. Nothing in these terms limits rights that cannot be waived under applicable law.

Artwork Information

We represent original fine art by independent artists. We make reasonable efforts to provide accurate descriptions, dimensions, materials, condition information, and photographs.

Artwork colors and appearance may vary depending on lighting, photography, and screen settings. Dimensions may be approximate unless expressly confirmed otherwise. Texture, handmade characteristics, and variations inherent in an artist’s materials or process are not defects when consistent with the artwork’s description.

Please contact us before purchasing if you need additional photographs, precise measurements, condition details, framing information, or installation guidance.

Inquiries, Availability & Purchase Agreements

Submitting an inquiry does not place an order, reserve artwork, or create an obligation to purchase.

Original artwork is often unique and may be offered through the gallery and other sales channels. Availability must be confirmed by Studio E Gallery. A purchase becomes binding when we confirm acceptance of the order in writing and receive the payment or deposit required under the agreed terms.

An artwork is not reserved unless we expressly confirm a hold in writing. Any hold is subject to the duration and conditions stated in that confirmation.

If an artwork becomes unavailable before we accept your order, we will notify you and refund any payment collected for that unavailable artwork.

Prices, Taxes & Payment

Prices are quoted in U.S. dollars unless otherwise stated. Prices may change before an order is accepted. We will confirm the purchase price and applicable charges in your invoice or written agreement.

Sales tax, shipping, packing, delivery, installation, and other services are additional unless expressly included. Applicable charges will be disclosed before you commit to the purchase or separately approve the service.

Payment is due according to the invoice or written agreement. Artwork will not be released, delivered, or shipped until the required balance has been paid and funds have cleared, unless we agree otherwise in writing.

We will not change an accepted purchase price without your agreement. If we discover a material pricing or description error before accepting an order, we will explain the correction so you can decide whether to proceed.

Commissions & Custom Work

Commissioned artwork is created specifically for the client. Before work begins, the written commission agreement will establish the scope, price, deposit, payment schedule, anticipated completion period, and approval process.

Unless otherwise agreed in writing, commissions require a deposit of 50% of the artwork price, plus applicable tax as stated on the invoice. The remaining balance and any outstanding approved charges are due after completion and approval, before release or shipment.

Unless the commission agreement states otherwise, deposits are nonrefundable once the commission is accepted and the artist is authorized to begin. Deposits reserve the artist’s time and support work undertaken specifically for the project.

The artist retains creative discretion within the agreed scope. Reference images and discussions guide the commission but do not guarantee an exact reproduction unless expressly agreed in writing.

Requests for revisions or changes in size, materials, framing, or other specifications require written agreement and may affect the price and completion schedule. Additional charges require the client’s approval before the additional work proceeds.

Completion dates are estimates unless expressly guaranteed in writing. We will communicate material changes to the anticipated schedule. Any cancellation or refund rights arising from a delay remain subject to the written agreement and applicable law.

If Studio E Gallery or the artist cannot fulfill the agreed commission and the client does not accept an alternative, payments for the unfulfilled commission will be refunded.

Shipping, Delivery & Collection

Shipping, local delivery, collection, and installation arrangements are confirmed individually based on the artwork and destination.

Please provide accurate delivery information and disclose access requirements, including stairs, elevators, building restrictions, appointment requirements, and installation conditions. Additional services or delivery attempts resulting from incomplete information or missed appointments may incur charges disclosed for your approval.

Delivery dates are estimates unless expressly guaranteed in writing. If a delay occurs, we will work with you and the carrier to resolve it.

For international shipments, responsibility for import duties, destination taxes, customs clearance, and related charges will be stated in the shipping quotation or purchase agreement before shipment.

If you arrange your own carrier, art handler, or installer, please confirm the handling and insurance arrangements with us before collection.

Inspection & Delivery Issues

Please inspect artwork promptly upon receipt. Report visible packaging damage to the delivery provider where practical, photograph the packaging and artwork, and retain all packing materials.

If artwork arrives damaged, is incorrect, or materially differs from the agreed description or specifications, contact us as soon as possible, preferably within seven calendar days of receipt. Please do not arrange repairs or return shipment before receiving our instructions.

We will review the issue and coordinate an appropriate resolution under our Returns & Refunds Policy. The requested reporting period does not limit rights available under applicable law.

Returns, Refunds & Cancellations

All artwork sales are final. We do not accept returns or exchanges for a change of mind, changes in decorating plans, size or placement preferences, or other personal preferences after purchase.

Commissioned artwork, custom framing, and other work ordered or altered specifically for a client are final sale.

Any exception must be agreed to in writing. Damage, incorrect artwork, material discrepancies, authorized returns, and approved refunds are addressed in our Returns & Refunds Policy, available on this website.

These final-sale terms do not exclude remedies required by applicable law.

Ownership & Copyright

Purchasing an artwork transfers ownership of the physical artwork once full payment has cleared and the artwork has been delivered or collected, unless otherwise agreed in writing.

Copyright and other intellectual property rights remain with the artist or other rights holder unless expressly transferred in a separate written agreement.

Purchasing artwork does not grant the right to reproduce it, manufacture merchandise from it, license its image, or otherwise commercially exploit it. Permission for those uses must be obtained from the appropriate rights holder.

Website photographs, artwork images, text, logos, and other content may not be reproduced or commercially used without permission, except as permitted by law.

Care & Installation

Artwork may require specialized handling, installation, and environmental conditions. Please follow any care or installation instructions provided and use qualified professionals where appropriate.

We are not responsible for damage caused after delivery or collection by improper handling, unsuitable installation, unauthorized alteration, or exposure to inappropriate environmental conditions, except to the extent the damage results from our acts or omissions or responsibility otherwise arises under applicable law.

Website Use

You may use this website to learn about our artists, view artwork, make inquiries, and communicate with the gallery.

You may not use the website unlawfully, interfere with its operation, attempt unauthorized access, introduce harmful software, or misuse its content or inquiry forms.

Links to third-party websites are provided for convenience. Those websites operate under their own terms and privacy practices.

Our collection and use of personal information are described in our Privacy Policy, available on this website.

Disputes & Governing Law

Please contact us first about any concern so we can work toward a resolution.

These terms and transactions with Studio E Gallery are governed by Florida law, subject to any mandatory consumer protections or other rights that apply in your jurisdiction.

Changes to These Terms

We may update these terms by posting a revised version on this website. Changes apply prospectively and do not alter previously accepted purchases or commission agreements without agreement.
